5 NEW PACIFICA DIRECTORS BEING ADDED AS DEFENDANTS IN LISTENERS' LAWSUIT

Dear All,
We are now preparing an amended complaint naming the five new directors illegally elected to the Pacifica board of directors on September 19th, and adding to our claims that the September 19th election must be nullified on the grounds that: (1) their election exceeds the number of directors permitted under Pacifica' Articles of Incorporation, (2) they failed to receive a simple majority vote of legally elected directors, (3) they failed to receive a 2/3rds majority vote as required by Pacifica's actual bylaws (before they were illegally amended), (4) the board meeting was illegally conducted in that all members could not hear each other, as required by California statutes for telephone conference meetings.

We are now in the last 3 months before trial begins on January 7th. During the next 2 months somewhere between 20 and 40 depositions must be taken or "defended" in order for us to gather evidence in "admissible" form to take our case to trial and to bring and defend motions for partial summary judgment. Each deposition will require 7-10 hours of attorneys' preparation time as well as 4-8 hours of actual deposition time, plus travel costs and costs of court reporter to make a certified transcript.

This is the most cost-intensive period of our lawsuit. Our current fundraising goal is $300,000. We have known throughout this almost 2-1/2 year legal battle (since the KPFA lockout) that the loss of Pacifica and its 5 stations would be a terrible blow to free speech and the independent press, and to our "progressive" community -- now we know, more than ever, how crucial it is to save this network as a source of information not available in the mainstream media and as means of communication for the peace movement we must build now, and over the coming period.
