Dear All --
After some excitement about possible settlement, at this point I don't see any settlement discussions taking place in the near term. I could be wrong, but I have not yet seen or heard anything from the board majority that gives me the impression that they are willing to all resign and relinquish control of Pacifica.

We are agressively preparing for trial. At the moment there are over 80 depostions scheduled (by both sides) between now and the end of September -- that means we must raise a LOT of money now (+/- $300,000) to adequately prepare for these depositions, along with all the discovery motions that will be needed & other major legal motions we are planning. The board majority intends to make this as expensive as possible by scheduling a lot of depositions of people with no knowledge of the issues in the lawsuits -- solely for purposes of harassment. We will be required to oppose these depositions to the court.

If you would like to organize a fundraising event in your area and need speakers, please contact me. If you are a take charge kind of person -- please go ahead and take charge. (There is only so much I can do, and I'm over my limit.)

Subject: Apropos of A PRE-NEGOTIATION PACIFICA LISTENER STRAW POLL and MEE...

Dear All --
With deepest affection -- the idea of "national unity" is more than I can bear. From the beginning of this fight (for me) more than 2 years ago (much longer for some of you), I have encountered some of the most passionate, committed, obstreperous, outspoken, opinionated, and beloved people I have ever known in my life.

But "unified" we have never been. We are radicals (most of us). We don't "follow the leader" (most of us). We are independent thinkers (most of us). That is why we love and are fighting for our Pacifica stations -- to restore and preserve those values. So, it is not surprising that we are not "unified." To make that the goal, is, I think, to kill the spirit that ennobles and moves us ... and I fear it, deeply. I believe such "unity" would signal the stillbirth of the new Pacifica we dream of and hope for.

Through the legal process I believe we can remove the usurpers from the Pacifica Board of Directors, and I believe we can set in place minimum criteria for developing a democratic a "political process" for rebuilding and recreating this precious national treasure -- a process that empowers those who were left out as Pacifica lost its vision, the listeners and staffs that built it.
